Our store is hosted on Shopify, which provides the e-commerce platform. Your purchase contract is concluded directly with us, not with Shopify.
2. Scope and acceptance
These Terms of Service (“Terms”) govern your access to and use of our website and related services (the “Services”), including any purchases made through the Services.
By using the Services or placing an order, you agree to these Terms and to our Privacy Policy, Refunds & Returns Policy, and Shipping Policy (together, the “Policies”).
3. Eligibility and consumer status
The Services are intended for individuals who can enter into legally binding contracts. These Terms are drafted for business-to-consumer (B2C) sales to consumers residing in the European Union.
4. Accounts and customer information
You may place orders as a guest or by creating an account. You agree to provide accurate, current, and complete information (including billing and delivery details) and to keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities carried out under your account.
5. Products and mandatory food information
We aim to present our products accurately. However, product appearance (including colour) may vary depending on your device and display settings.
Mandatory food information, including ingredients, allergens, net quantities, storage conditions, and other particulars required under Regulation (EU) No 1169/2011, is provided on the product page and/or on the product packaging. If you have any questions, particularly regarding allergens or suitability, please contact us before placing an order.
6. Ordering process and contract formation
- Placing an order constitutes an offer to purchase.
- The contract is formed when we send you an order confirmation/acceptance (typically by email) and receive successful payment authorisation.
- If we cannot accept your order (e.g. due to stock unavailability, payment issues, delivery constraints, or suspected fraud), we will inform you and refund any amounts received, where applicable.
7. Prices, currency, taxes, and payment
Prices are displayed in euros (EUR) and include VAT where applicable. Delivery costs and any additional charges are shown at checkout before you confirm your order.
We accept the payment methods displayed at checkout. Payment must be received in full before dispatch.
8. Delivery, transfer of risk, and failed delivery
We deliver exclusively within the European Union to the countries displayed at checkout.
Estimated delivery times are indicative and not guaranteed.
Transfer of risk: for consumer contracts, the risk of loss or damage passes to you when you, or a third party designated by you (other than the carrier), acquire physical possession of the goods.
If delivery fails due to incorrect address details provided by you, or your failure or refusal to accept delivery, we may charge reasonable additional costs for re-delivery or return handling, as permitted by applicable law.
9. Right of withdrawal (EU consumers)
If you are a consumer in the EU, you have the right to withdraw from your purchase within 14 calendar days without giving any reason, provided that no statutory exception applies.
The withdrawal period expires 14 days from the day on which you, or a third party designated by you (other than the carrier), acquire physical possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. by email to info@t-nuts.store).
9.1 Food products – applicable exceptions
In accordance with EU consumer law, the right of withdrawal does not apply to:
- Goods liable to deteriorate or expire rapidly; and
- Sealed goods which are not suitable for return due to health protection or hygiene reasons, once unsealed after delivery.
Because we sell food products, the right of withdrawal applies only to products that remain sealed, intact, and in their original condition. Once a food product has been opened or unsealed, the right of withdrawal no longer applies, except where the product is defective or non-conforming.
9.2 Effects of withdrawal
Where withdrawal is valid and applicable:
- We will reimburse you within 14 calendar days after we receive the returned goods or evidence of their return (whichever occurs first), using the same payment method unless otherwise agreed.
- You may be responsible for the direct cost of returning the goods, unless we state otherwise.
You are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
10. Returns and refunds (operational policy)
Details of our practical returns process are set out in our Refunds & Returns Policy. Statutory consumer rights always prevail over any voluntary policy.
11. Legal guarantee and non-conformity
Under EU law, goods are covered by a minimum 2-year legal guarantee of conformity. If a product is defective, incorrect, damaged on arrival, or otherwise non-conforming, you may be entitled to remedies such as repair, replacement, price reduction, or termination of the contract, in accordance with applicable national law.
12. Food safety, storage, and consumer responsibility
Our food products must be stored, handled, and consumed in accordance with the storage conditions and instructions indicated on the product packaging and/or product page.
We are not responsible for deterioration, loss of quality, or adverse effects resulting from improper storage (including exposure to heat, humidity, light, or contamination), use after the indicated best-before or use-by date, or use contrary to the product’s intended purpose.
This clause does not limit or exclude any mandatory consumer rights relating to product conformity or food safety.
13. Complaints and alternative dispute resolution (ADR)
If you have a complaint, please contact us first so that we can attempt to resolve it promptly.
EU consumers may have access to alternative dispute resolution (ADR) bodies, depending on the law of their country of residence.
Portugal: consumers may use the Electronic Complaints Book (“Livro de Reclamações”) and consult recognised arbitration/ADR entities:

14. Intellectual property
All content on the Services is owned by or licensed to us and protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only.
15. Limitation of liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful, including liability for death or personal injury caused by negligence, fraud, or mandatory consumer rights.
Subject to the foregoing, our liability is limited to the maximum extent permitted by applicable law.
16. Governing law, jurisdiction, and language
These Terms and any contracts concluded under them are governed by Portuguese law, without prejudice to the mandatory consumer protection laws of your country of residence within the EU.
You may bring proceedings in the courts of your country of residence. We may bring proceedings against you only in the courts of your country of residence, where applicable.
Language: These Terms are drafted in English. In case of discrepancies between language versions, the English version shall prevail.
